The New Canada Not-for-Profit Corporations Act

It has just been announced by the Department of Justice (Corporations Canada) that as of  October 17, 2011, the new Canada Not-for-profit Corporations Act came into effect. This marks an important occasion which adds a new set of modernized and flexible rules for creating, organizing and maintaining a non-for-profit company in Canada.

Based on this new date of enactment, the last day for submitting an application for incorporation under the old legislation (Canada Corporations Act, Part II) was October 16, 2011, and as of today, any new non-for-profit corporation will be incorporated under the newly enacted legislation.

Since the old legislation will be repealed following the new enactment, organizations which incorporated under it will have until October 17, 2014 to transition to the new act.
